Your data is processed for the sole purpose of responding to your inquiries, delivering requested services, maintaining operational performance records, and complying with legal obligations under German and EU law.

Processing is based on Article 6(1)(b) GDPR — performance of a contract or pre-contractual measures — and Article 6(1)(f) GDPR — legitimate interest in improving our services and ensuring system security.

5. Data Retention

Personal data is retained for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law. Contact form submissions are retained for 24 months after the last communication.

6. Your Rights

Under GDPR, you have the right to access, rectify, erase, restrict processing, and port your personal data. You may also object to processing and lodge a complaint with the supervisory authority (Die Landesbeauftragte für den Datenschutz und die Informationsfreiheit Hamburg).

Terms of Service

Effective: January 1, 2026

1. Agreement to Terms

By engaging DigiVisionLabs for services, you agree to these Terms of Service. DigiVisionLabs, registered at Stockhausenstrasse 5, 22305 Hamburg, Germany, provides digital web platforms, software architecture consulting, and automation tools.

2. Scope of Services

Services include custom web platform engineering, software architecture consulting, workflow automation, legacy system modernization, interface design, performance optimization, cloud infrastructure, SEO, and security hardening. Each project scope is defined in a separate Statement of Work (SOW).

3. Payment Terms

Invoices are due within 14 days of issuance unless otherwise agreed in writing. Late payments incur a statutory interest rate of 5 percentage points above the ECB base rate. All prices are in EUR and exclude applicable VAT.

4. Intellectual Property

Upon full payment, all deliverables and associated intellectual property rights transfer to the client. DigiVisionLabs retains the right to display non-confidential project outcomes in portfolio materials unless explicitly restricted in writing.

5. Limitation of Liability

DigiVisionLabs shall not be liable for indirect, incidental, or consequential damages. Total liability is limited to the total project fee paid. This limitation does not apply to cases of gross negligence or willful misconduct.

6. Termination

Either party may terminate with 30 days written notice. In case of termination, the client pays for all work completed up to the termination date. Non-refundable third-party costs incurred are passed through at cost.

7. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Disputes shall be resolved in the courts of Hamburg, Germany.

Refund Policy

Effective: January 1, 2026

1. General Policy

DigiVisionLabs, located at Stockhausenstrasse 5, 22305 Hamburg, Germany, evaluates refund requests on a case-by-case basis. We are committed to delivering value and will work to resolve any concerns before issuing refunds.

2. Pre-Project Refunds

If a project has not yet commenced, you may request a full refund within 14 days of payment. Refund requests must be submitted in writing to [email protected].

3. In-Progress Projects

For projects already in progress, refunds are calculated based on completed milestones and work delivered. You will be invoiced for all work completed up to the date of termination. Any advance payments for undelivered work will be credited.

4. Completed Deliverables

Once a deliverable has been approved and delivered, it is considered non-refundable. Revisions and modifications within the original project scope are included in the agreed project fee.

5. Third-Party Costs

Non-refundable third-party costs (domain registrations, hosting fees, licensed software, API credits) incurred during the project are passed through at cost and are not eligible for refund.

6. Refund Processing

Approved refunds are processed within 14 business days via the original payment method. Refund confirmation is sent to the email address on file.

7. Dispute Resolution

If you are unsatisfied with a refund decision, you may escalate the matter in writing. DigiVisionLabs will review the case within 10 business days. Unresolved disputes are subject to the jurisdiction of the courts of Hamburg, Germany.
